§9 AVAILABILITY OF GOODS
All orders are subject to acceptance and checking the availability of goods. If the ordered goods are not available, we will contact you by e-mail or by phone (in accordance with the information provided to us). The customer will be able to wait for the availability of the goods or cancel the order.
§10 MISTAKES IN ORDERS
The user can correct any mistakes and errors in the order until the "send" button is pressed during the ordering process.
§11 APPLICATION OF THIS REGULATIONS
The conditions set out in these regulations apply in situations not described in the other regulations and each user agrees to abide by them.
We reserve the right to amend these regulations at any time. In the event of a change to the regulations, the updated version of the regulations will be posted on the website and each user will be obliged to comply with it from the date of its publication.
§12 NOTIFICATIONS ADDRESSED TO US
Unless otherwise stated in these regulations, we only accept written notices sent to us at the contact address.
§13 LAW AND LANGUAGE
This website, all content contained therein, as well as any contract concluded as a result of the use of this website are governed and interpreted in accordance with Polish law. The parties to such an agreement consent to submit to the exclusive jurisdiction of Polish courts. Agreements are concluded in English / German / Polish.
§14 INVALIDITY OF THE REGULATIONS
If any of the terms of these terms and conditions cannot be met (including the provisions excluding our liability), the remaining terms of these terms and conditions will continue to apply and should be complied with.
§15 CHANGES TO THE REGULATIONS
We reserve the right to change the conditions contained in these regulations, we recommend that you follow the changes on a regular basis.
§16 PAYMENT
For a completed order, payment can be made, depending on the buyer's choice, through the payment platform: PayPal, PayU, or Przelewy24.
§17 ORDER FULFILLMENT
The Seller is obligated to deliver defect-free goods. The order fulfillment deadline is indicated in the store. The Seller will commence order fulfillment upon its payment. The goods are delivered within the European Union according to the Buyer's chosen delivery method. Items purchased in the store are delivered depending on the Buyer's selected delivery method: UPS or DPD. Most orders are shipped within two days and reach the customer within 2-4 business days. In some cases, such as during holidays or for international shipments outside of Poland, delivery time may extend to 5-9 business days. Details regarding costs and delivery times to specific countries can be found in the "Payment and Shipping" section.
§18 RIGHT OF WITHDRAWAL
The consumer and an individual entering into a contract directly related to their business activity, when it is evident from the contract that it does not have a professional character for that person, have the right to withdraw from the contract concluded with the seller through the store within 30 days without stating any reason. The withdrawal period expires 30 days from the day the consumer or the person took possession of the goods. To exercise the right of withdrawal, the consumer must inform the seller, using the contact details provided in the terms and conditions, of their decision to withdraw from the contract by means of an unequivocal statement (e.g., a letter sent by mail or an email). A withdrawal form is included in the package with the ordered goods. In case of withdrawal from the contract, the seller refunds all payments received from the consumer, including the cost of delivering the goods (except for additional costs resulting from the consumer's chosen method of delivery other than the cheapest standard delivery offered by the seller), without undue delay and in any event not later than 14 days from the day the seller is informed of the consumer's decision. The seller may withhold the refund until receiving the goods or until the consumer provides proof of their return. The seller requests the return of goods to the address: Bajo Handel Barbara Bajor Store, Grodzka 60, 31-044 Kraków. Promptly, and in any case no later than 14 days from the day the consumer informed the seller of the withdrawal from the sales contract. The consumer bears the direct costs of returning the goods.
§19 COMPLAINTS
In the event of a defect in the goods, the buyer has the right to lodge a complaint about the defective product based on the statutory warranty or guarantee, if provided. Using the statutory warranty, the buyer may, according to the rules and deadlines specified in the Civil Code: submit a declaration of price reduction, in the case of a significant defect - submit a declaration of withdrawal from the contract, demand the exchange of the item for one free from defects, demand the removal of the defect. The seller requests that complaints based on the statutory warranty be sent to the postal or electronic address specified in the terms and conditions. The complaint should include: the buyer's full name and correspondence or email address to which the response to the complaint should be directed, the reason for filing the complaint, and the request. If it turns out that the return of the complained goods to the seller is necessary for the complaint to be considered, the buyer is obliged to deliver the goods, in the case of a consumer at the seller's expense, to the address Grodzka 60, 31-044 Kraków. The seller will handle the complaint within 14 days. The seller processes complaints based on the regulations and provisions of the law generally applicable in Poland. The response to the complaint is provided in accordance with the instructions of the person filing the complaint, i.e., by postal correspondence or by email.
§20 PERSONAL DATA PROTECTION POLICY
The seller is the administrator of personal data provided by the buyer when using the store. Detailed information regarding the processing of personal data by the seller, including other purposes and legal bases for data processing, as well as data recipients, can be found in the privacy policy available in the store. The purpose of processing the buyer's data by the seller is order fulfillment. The legal basis for processing personal data in this case is the sales agreement or actions taken at the request of the buyer aimed at its conclusion (Art. 6(1)(b) GDPR), the seller's legal obligation related to accounting (Art. 6(1)(c)), and the seller's legitimate interest in processing data to establish, assert, or defend against possible claims (Art. 6(1)(f) GDPR). Regarding personal data provided by the buyer in connection with the creation of an account: the performance of the account management service. The legal basis for processing personal data in this case is the agreement on the provision of electronic services or actions taken at the request of the buyer aimed at its conclusion (Art. 6(1)(b) GDPR), and the seller's legitimate interest in processing data to establish, assert, or defend against possible claims (Art. 6(1)(f) GDPR). Providing data by the buyer is voluntary but necessary for the conclusion of a sales contract or the provision of an account management service. Failure to provide data will prevent the conclusion of a sales contract in the store or the management of an account. The buyer has the right to request: access to their personal data, rectification of their personal data, erasure of their personal data, restriction of the processing of their personal data, and the transfer of data to another administrator. The buyer also has the right to object at any time to the processing of data for reasons related to their particular situation - concerning the processing of their personal data based on Art. 6(1)(f) GDPR (i.e., on the legitimate interests pursued by the administrator). To exercise their rights, the buyer should contact the seller using the contact details from the terms and conditions. The buyer exercises their rights in accordance with the provisions regarding personal data protection. If the buyer believes that their data is processed unlawfully, they may file a complaint with the President of the Office for Personal Data Protection.
